New York State Grants Allow Full-Time Students to Keep Unemployment Benefits
The Program 599 exemption can provide up to 26 weeks of extra support, but a $20 million annual cap creates a waiting list based on approval dates.

The New York State Department of Labor allows individuals receiving unemployment insurance to pursue full-time education without immediately losing their weekly payments. This provision operates under the Program 599 framework, which can exempt beneficiaries from the standard requirement to actively seek employment while they attend classes. If the department approves the training before the individual exhausts their regular benefits, they may qualify for up to 26 weeks of additional support under section 599.2.
The approval process is specific. The training must target a particular occupation and meet the educational requirements for that job. It must also improve the individual’s chances of finding stable work in the state or local market. Programs must include at least 12 academic credits per semester or 12 weekly class hours and be completable within 24 months of approval. High school equivalency certificates are also eligible if they meet the 12-hour weekly minimum and have a defined completion date.
Applicants must possess the skills to complete the training and maintain passing grades. They are required to submit transcripts, schedules, or other proof of progress periodically. To maximize the available benefits, the Department of Labor recommends submitting the Program 599 form as soon as a school accepts the student. Those already enrolled when applying for unemployment benefits should file the request immediately. Delays can reduce additional payments, while failing to disclose enrollment can result in sanctions and the loss of future benefits.
A major limitation is the funding cap. State law limits section 599.2 additional payments to $20 million annually. Because of this ceiling, a waiting list exists. Payment priority is established every July 1 based on the dates of study approval. The official reference date for available funds is August 17, 2026. Individuals with approvals after that date remain on the list. There is no fixed queue number; position depends on the approval date, the number of people with the same date, and available money.
While waiting for funds, individuals cannot certify those additional benefits. When their case is evaluated, they receive a questionnaire that must be returned with their academic history within 14 days. If they qualify, payments begin when funds become available. The program does not pay retroactively for the waiting period. Anyone who finishes their studies before funds are available will not receive the additional payments. The program does not cover tuition costs.
Individuals can request the form or ask questions by calling 518-402-0189. Those who have not yet selected a course of study can receive guidance from a New York State Career Center. More details are available on the official Program 599 webpage.
