Prosecutors have charged two former senior FBI officials with lying to Congress regarding the bureau's handling of investigations into Hunter Biden. The Justice Department announced the indictment on Friday against Nikki Floris, a former intelligence division leader in the Washington field office, and Bradley Benavides, a former deputy assistant director for counterintelligence. Both were released on bail following a brief court appearance on Friday morning.

The indictment alleges that Floris and Benavides intentionally withheld information while testifying before the House Judiciary Committee in 2023. If convicted on the perjury counts, each faces a maximum prison sentence of five years. US Attorney Jeanine Pirro stated that the pair compromised the institutions they served. She argued that senior agents who believe they are above the law warrant strong legal action.

According to the FBI affidavit, Floris denied any role in the Hunter Biden investigations during her testimony. The document claims she was in frequent communication with the case team for more than a year. It also asserts she coordinated the bureau's response to news reports about the laptop in real time, despite claiming she knew nothing of its existence. Benavides testified months later that he learned about the laptop from a Wikipedia entry while preparing for his session. The affidavit contradicts this, stating he maintained constant communication about the device over several days.

A member of the House Judiciary Committee said the officials' answers shaped the committee's direction. The member claimed the testimony thwarted follow-up interviews and subpoenas. Defense attorneys for Floris rejected the charges, arguing the government relied on political assertions rather than factual evidence. They described Floris as a patriot who served as an intelligence officer for nearly 20 years. Their legal team noted the timing of the filing, describing the charges as nonsense brought on the eve of an election.

Ron Safer, attorney for Benavides, asked the court to review whether prosecutors possess sufficient evidence against two long-serving public servants. US Magistrate Judge Zia M. Faruqui expressed concern about the age of the charges. He noted the testimony occurred more than three years before the indictment. Faruqui granted the defense request for an evidentiary hearing, setting it for Tuesday. He called the schedule rare for defendants who have been released.

Faruqui described the defendants as having sparkling backgrounds in law enforcement. He emphasized their interest in clearing their names quickly while acknowledging the lingering impact of the case. The judge stated that the matter would follow them for the rest of their lives. The laptop at the center of the dispute has remained a partisan symbol. Republicans view it as evidence of corruption in the Biden family, while Democrats characterize it as a political weapon.

The device was handed to the FBI in 2019 after a computer shop owner said Hunter Biden dropped it off and did not return. The owner told the Washington Post he turned it over to authorities after viewing some of its contents. The case arrives amid a wider reshaping of the bureau. Many agents who worked on investigations involving President Donald Trump have been pushed out since the start of his second term. Some claim they were dismissed for their work, while others say loyalty to the president was the deciding factor.
